  • Adverse Impact – By leveraging years of experience in EEO Litigation, BCG is uniquely qualified to help your organization identify and mitigate problem areas associated with hiring, promotional, and termination decisions. BCG’s consultants provide the needed expertise to analyze complex organizational processes with the appropriate statistical analyses.
  • Test Validation – If adverse impact is identified in a particular practice, procedure, or test (including interviews), an employer is required to show that the test is job-related for the position in question and consistent with business necessity . . . in other words, that it’s valid. BCG’s consultants have developed hundreds of valid tests and have worked with employers to defend tests that have come under scrutiny by enforcement agencies.
  • Compensation Analyses – Regression analyses may seem new to many contractors, but they are nothing new to BCG. We’ve been using regression to explain compensation disparities for over 30 years. With the OFCCP’s own statistical experts paying close attention to compensation during even the most routine audits, it should be a requirement that contractors proactively analyze compensation data prior to submitting it to the OFCCP. BCG is prepared to mimic the OFCCP’s compensation analysis approach and work with contractors to proactively and conclusively investigate disparities.
  • Corporate Management Review (CMR)/Glass Ceiling Audit – Typically a CMR focuses on contractors’ management personnel in order to identify systemic disparities in promotional and compensation practices. As a result, a CMR can include considerable back-pay and interest for employers who are unable to justify significant differences in compensation or promotion rates. With a lengthy history in EEO litigation support, BCG can properly investigate compensation and promotional decisions to identify the true cause of disparities.
